Hukuk Dairesi 2015\/6244 Esas ve 2016\/2299 numaral\u0131 karar ile milyonlarca ki\u015fiyi ilgilendiren cam balkon hakk\u0131nda emsal karar a\u00e7\u0131klad\u0131.<\/p>\n<p>\u0130\u015fte Yarg\u0131tay\u2019\u0131n emsal karar\u0131:<\/p>\n<p>Temyiz isteminin s\u00fcresi i\u00e7inde oldu\u011fu anla\u015f\u0131ld\u0131ktan sonra dosyadaki b\u00fct\u00fcn ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>Davac\u0131 vekili dava dilek\u00e7esinde, daval\u0131ya ait 42 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmde projeye ayk\u0131r\u0131 olarak kapat\u0131lan a\u00e7\u0131k balkonun eski hale getirilmesini istemi\u015f, mahkemece davan\u0131n reddine karar verilmi\u015ftir. 634 say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131&#8217;n\u0131n 19.maddesinin birinci f\u0131kras\u0131nda kat maliklerinin ana ta\u015f\u0131nmaz\u0131n mimari durumunu titizlikle korumaya mecbur olduklar\u0131n\u0131n alt\u0131 \u00e7izildi. \u0130kinci f\u0131krada ise kat maliklerinden birinin b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a ana ta\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m, tesis ve de\u011fi\u015fiklik yap\u0131lamayaca\u011f\u0131 belirtildi.<\/p>\n<p>BALKON \u0130LE MUTFA\u011eI B\u0130RLE\u015eT\u0130RD\u0130<\/p>\n<p>Dosya i\u00e7erisindeki bilgi ve belgelerden, \u00f6zellikle bilirki\u015fi raporu i\u00e7eri\u011finden; daval\u0131ya ait ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn mutfa\u011fa ba\u011flant\u0131l\u0131 balkonunun mutfakla balkon aras\u0131ndaki kap\u0131, pencere ve duvar\u0131n\u0131n kald\u0131r\u0131larak mutfakla birle\u015ftirildi\u011fi, balkonun PVC malzemeyle kapat\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.Bilirki\u015finin yerinde saptad\u0131\u011f\u0131 sistem, Yarg\u0131tay uygulamalar\u0131nda da kabul edildi\u011fi gibi sabit eser niteli\u011finde olup b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmadan yap\u0131lamaz.
